These Terms of Service ("Terms") govern your use of the websites and services operated by Melnicom Ltd ("Melnicom", "we", "us", "our"), an Israeli company registered under number 514130657 at 3 Habsamim Road, Ganey Tikva, Israel. This includes melnicom.co.il, melnicom.com, and the Tlyck platform and all of its sites, including tlyck.com, robots.tlyck.com, pa.tlyck.com, focus.tlyck.com and coach.tlyck.com, together with all SMS messaging programs we operate.
By creating an account, subscribing, or sending or receiving messages through our services, you agree to these Terms. If you do not agree, do not use the services.
1. The Service
Melnicom provides AI-powered assistant software. Depending on the product you subscribe to, your assistant may exchange messages with you over SMS, WhatsApp, Telegram, email, voice or the web, and may perform actions you ask it to perform through integrations you have connected. The service is provided on a subscription basis.
2. Eligibility and Your Account
You must be at least 16 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you give us, for keeping your account credentials secure, and for all activity under your account. You must provide a mobile number that belongs to you, or that you are authorised to enrol.
3. SMS Messaging Terms
Melnicom Ltd operates the following SMS programs in the United States:

3.1 Consent
By providing your mobile number and accepting the consent language shown at sign-up, you agree to receive text messages from your Tlyck assistant at that number. Consent is not a condition of any purchase of goods or services other than the messaging service itself. Consent applies only to the program you signed up for.
3.2 Message type and frequency
Messages are one-to-one and conversational: reminders, calendar and task updates, answers to questions you text in, and messages you explicitly ask your assistant to send on your behalf. We do not send marketing or promotional text messages. Message frequency varies and depends on how you use the service.
3.3 Costs
Message and data rates may apply. Your mobile carrier's standard rates apply to messages you send and receive. Melnicom is not responsible for carrier charges. Carriers are not liable for delayed or undelivered messages.
3.4 Opting out
Reply STOP to any message to unsubscribe from that program. You will receive one confirmation message and then no further messages from that number. Opting out of one program does not opt you out of another; reply STOP to each number you wish to stop. Reply HELP for help, or email support@tlyck.com.
3.5 Supported carriers
Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, US Cellular, and most other US carriers. Carriers are not liable for delayed or undelivered messages.
3.6 Privacy
Your mobile number and consent record are handled under our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
4. Acceptable Use
You may not use the service to send unlawful, harassing, deceptive, or unsolicited bulk messages; to message people who have not consented to hear from you; to infringe anyone's rights; to attempt to gain unauthorised access to our systems or those of others; or in breach of any applicable law, carrier rule, or messaging industry standard, including the CTIA Messaging Principles and Best Practices and the Telephone Consumer Protection Act. We may suspend or terminate accounts that breach this section.
5. Fees, Billing and Cancellation
Subscription fees, billing period and any trial terms are shown at checkout for the product you buy. Subscriptions renew automatically at the stated price until cancelled. You may cancel at any time; cancellation takes effect at the end of the period you have already paid for, and access continues until then. Fees already paid are non-refundable except where required by law.
6. Third-Party Services
The service integrates with third-party providers, including messaging carriers, AI inference providers, payment processors and any accounts you choose to connect. Your use of those services is governed by their own terms. We are not responsible for their availability or their acts and omissions.
7. AI Output
Assistant responses are generated by AI models and may be inaccurate or incomplete. They are not professional, legal, medical or financial advice. You are responsible for reviewing any output before relying on it or acting on it, and for any action you instruct your assistant to take on your behalf.
8. Intellectual Property
The service, its software and its content are owned by Melnicom Ltd and are protected by intellectual property law. You retain ownership of the content and data you provide. You grant us a limited licence to process that content solely to operate the service for you.
9. Disclaimers and Limitation of Liability
The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that any message will be delivered. To the fullest extent permitted by law, our total liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months preceding the event giving rise to the claim, and we are not liable for indirect, incidental, special, consequential or punitive damages.
10. Suspension and Termination
You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law or by a carrier, or if your use poses a risk to the service or to others. On termination, your data is handled as described in our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. The "last updated" date at the top of this page reflects the current version. Continued use of the service after a change means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Yafo have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights available to you where you live.
